1. Information We Collect

A. Information You Provide

• Business information (for business accounts)
• Business logos, profile images, and promotional content
• Lodging listing details (if applicable)
• Messages sent through the App
• Subscription and billing information

Subscriptions and digital purchases are processed through Apple App Store In-App Purchase (iOS) and Google Play Billing (Android). Market Ember does not directly collect or store full payment card numbers.

B. Location Information

Market Ember uses location services to:

• Display promotions within a 25-mile radius
• Show nearby businesses
• Allow users to search promotions near another address

With your permission, we may collect:

• Precise GPS location
• Approximate location via IP address

You may disable location services in your device settings, but some features may not function properly.

C. Automatically Collected Information

• Device type and operating system
• IP address
• App usage data
• Interaction data
• Crash logs and diagnostics

D. Analytics & Advertising

We use third-party analytics tools including:

• Google Analytics / Firebase
• Meta (Facebook) Analytics and advertising tools

These services may collect information about your device and App usage to analyze performance, improve user experience, and measure advertising effectiveness. These third parties may use cookies, SDKs, or similar technologies consistent with their privacy policies.

• Operate and maintain the App
• Provide location-based promotions
• Manage business and lodging listings
• Process subscriptions

4. Business & Public Listings

• Provide services

• Resolve disputes

You may request deletion of your account at any time.

6. Account Deletion

Users may request deletion of their account by:

• Using the in-app account deletion feature (if available), or

Upon verification, we will delete or anonymize your data unless legally required to retain it.

We may update this Privacy Policy periodically. Updates will be posted within the App with a revised "Last Updated" date. Continued use of the App constitutes acceptance of changes.

1. Eligibility

You must be at least 18 years old to create a business account. Users under 18 must use the App with parental consent.

2. User Accounts

You agree to:

• Provide accurate information
• Maintain account confidentiality
• Not share login credentials
• Notify us of unauthorized use

We reserve the right to suspend or terminate accounts for violations.

3. Business Accounts

Business users agree to:

• Post truthful promotions
• Honor advertised offers
• Comply with federal, state, and local laws
• Avoid misleading or deceptive practices

Market Ember is a promotional platform and does not guarantee business results. We may remove content that violates these Terms.

4. Subscriptions & Payments

A. Business Subscriptions

• Subscription products (including title, duration, and price) are shown in-app before purchase.
• Available plans may include monthly and/or annual options depending on your device store and region.
• Subscriptions are billed through Apple App Store In-App Purchase (iOS) or Google Play Billing (Android).
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your store account (Apple ID or Google account) is charged for renewal within 24 hours before the current period ends.
• Fees are non-refundable unless required by law.
• Failure to pay may result in suspension.

B. Subscriber Features

Users may purchase premium access to exclusive promotions through Apple App Store or Google Play in-app purchase systems.

C. Cancellation

• iOS users can manage or cancel subscriptions in Apple ID account settings after purchase.
• Android users can manage or cancel subscriptions in the Google Play Subscriptions section.
• Deleting the app does not automatically cancel an active subscription.

5. Promotions & Offers

Market Ember is not a party to transactions between businesses and customers. We:

• Do not guarantee availability of promotions
• Are not responsible for disputes
• Do not control inventory or pricing

All transactions occur directly between users and businesses.

6. Lodging Listings

If lodging services are listed:

• Property owners are responsible for accuracy
• Market Ember is not a travel agency or booking agent unless explicitly stated
• We are not liable for cancellations, damages, or disputes

Users must resolve lodging disputes directly with the provider.

7. Prohibited Conduct

You agree not to:

• Post illegal content
• Violate intellectual property rights
• Interfere with App security
• Create fraudulent accounts
• Engage in scraping or data harvesting
• Conduct fraudulent promotions

Violations may result in immediate termination.

8. Intellectual Property

All App content, branding, design, and software are owned by Market Ember LLC. Users retain ownership of submitted content but grant us a non-exclusive license to display and promote it within the App.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE." We make no warranties regarding accuracy, availability, reliability, or fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, Market Ember LLC shall not be liable for indirect or consequential damages, lost profits, business interruption, or user disputes. Total liability shall not exceed the amount paid by you in the previous 12 months.

11. Indemnification

You agree to indemnify and hold harmless Market Ember LLC from claims arising from your content, your promotions, your misuse of the App, or violations of these Terms.

12. Termination

We may suspend or terminate accounts for violations of these Terms. Users may delete their accounts at any time.

13. Governing Law

These Terms are governed by the laws of the State of Mississippi, United States.

14. Changes to Terms

We may update these Terms at any time. Continued use of the App constitutes acceptance.
